Platform Name: ProximaRide (“we”, “us”, or “our”)

 

Welcome to ProximaRide, a peer-to-peer ridesharing platform designed to connect drivers and passengers for cost-sharing travel. By using our website, mobile application, or services (collectively, the “Platform”), you agree to comply with and be legally bound by the terms and conditions outlined below (“Terms”).

 

If you do not agree to these Terms, do not use the Platform.

 

1. Definitions
User: Any person who registers for or uses the Platform, including Drivers and Passengers.

Driver: A User offering a ride.

Passenger: A User booking a ride.

Trip: A ride offered or booked through the Platform.

Trip: A ride offered or booked through the Platform.

Content: Any information, text, graphics, photos, or other materials uploaded, downloaded, or appearing on the Platform.

 

2. Eligibility
To use ProximaRide, you must:

Be at least 18 years of age.

Have the legal capacity to enter into a binding agreement.

Hold a valid driver’s license (Drivers only).

Own or have legal access to a properly insured vehicle (Drivers only).

Provide accurate and complete registration information.

We reserve the right to deny access to any user who fails to meet these requirements.

 

3. Platform Usage

3.1 Role of ProximaRide
ProximaRide acts solely as a marketplace to connect Drivers and Passengers. We do not operate any transportation services and are not a party to any agreement between Users.

 

3.2 Driver Responsibilities
Ensure that your vehicle is roadworthy, legally registered, and insured.

Comply with all local and national traffic laws.

Do not collect more than the agreed-upon cost-share.

Accurately describe your trip, including departure time, pickup/drop-off points, and cost.

Be punctual and communicate clearly with Passengers.

 

3.3 Passenger Responsibilities
Arrive on time at the agreed pickup location.

Pay the agreed-upon fare via the ProximaRide payment system.

Behave respectfully and follow the Driver’s reasonable requests.

Do not bring illegal or hazardous materials on the ride.

 

4. Payments and Fees
Drivers may only receive payments for fuel and vehicle operating costs on a cost-sharing basis. Profit-making is strictly prohibited.

All online payments must be made via ProximaRide’s integrated payment system.

ProximaRide may charge a service fee on each transaction. The fee will be clearly disclosed at the time of booking.

 

5. Cancellations and Refunds
Drivers and Passengers may cancel trips prior to departure.

Late cancellations or no-shows may incur penalties or affect your user rating.

Refunds are processed according to our Cancellation and Refund Policy, available on the Platform.

ProximaRide reserves the right to mediate and determine refund eligibility.

 

6. Insurance and Liability
Drivers must carry valid personal auto insurance that covers carpooling.

ProximaRide does not provide any insurance coverage for rides.

Users accept full responsibility for any risks associated with their participation in ridesharing.

We are not liable for any accidents, damages, injuries, losses, or claims arising from the use of the Platform or during a Trip.

 

7. User Conduct and Safety
Users agree to:

Use ProximaRide only for lawful and non-commercial purposes.

Not impersonate another person or provide false information.

Not harass, abuse, threaten, or harm other Users.

Not post or transmit any illegal, defamatory, or obscene content.

We may suspend or terminate access to Users who violate these rules.

 

8. Ratings and Reviews
After each Trip, Users may rate each other and leave reviews. These reviews:

Must be truthful, respectful, and non-defamatory.

Will be publicly visible to other Users.

May be used by ProximaRide to assess user eligibility or enforce policy.

We reserve the right to moderate or remove inappropriate reviews.

 

9. Account Termination
We may suspend or terminate your account at any time if:

You breach these Terms.

You engage in harmful or fraudulent behavior.

We are required to do so by law.

Users may close their account at any time via account settings.

 

10. Privacy Policy
Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

 

11. Intellectual Property
All content and trademarks on the Platform are owned by ProximaRide or its licensors. Users may not copy, reproduce, or distribute Platform content without permission.

 

12. Dispute Resolution
Any disputes between Users should be resolved amicably.

If unresolved, Users may contact ProximaRide for mediation support.

These Terms are governed by the laws of Quebec, Canada. Any legal disputes must be brought before the courts of Quebec, Canada.

 

13. Changes to Terms
We may revise these Terms at any time. Updates will be posted on the Platform with a revised effective date. Continued use of the Platform after changes constitutes acceptance.
